Starzynski v. Cap. Pub. Radio, Inc., 88 Cal. App. 4th 33, 105 Cal. Rptr. 2d 525 (2001)

Former employee filed a complaint against his former employer alleging wrongful discharge on the theories that the employer violated an implied contract of employment, violated an implied covenant of good faith and fair dealing, and had constructively discharged the employee when he resigned due to intolerable working conditions. The Superior Court, Sacramento County, No. 98AS03212, Joe S. Gray, J., entered summary judgment for the employer. Former employee appealed. The Court of Appeal, Sims, Acting P.J., held that: (1) employee’s claim that he had an implied contract of employment providing for termination only for good cause was meritless; (2) employer was not liable for breach of implied covenant of good faith and fair dealing; and (3) employee failed to allege wrongful discharge upon which to base a viable constructive discharge claim on account of intolerable working conditions.
