The Superior Court granted summary judgment to the employer and supervisor. On appeal the Court of Appeal, held that: 1 genuine issue of material fact as to whether employee was constructively discharged by alleged demeaning criticisms by supervisor precluded summary judgment as to discrimination cause of action; 2 genuine issue of material fact as to whether supervisor’s alleged conduct was motivated by discriminatory animus based on employee’s national origin and age precluded summary judgment on employee’s harassment cause of action; 3 genuine issue of material fact as to whether supervisor’s alleged conduct was sufficiently severe or pervasive to interfere with a reasonable employee’s work performance and seriously affect the psychological well-being of a reasonable employee precluded summary judgment on employee’s harassment cause of action; 4 trial court abused discretion in excluding portion of employee’s declaration stating that she did not have sufficient training or orientation necessary to work in hospital department to which she was involuntarily transferred; 5 trial court abused discretion in excluding portion of employee’s declaration stating that she resigned due to stress and anxiety; and6. witness’s declaration that he heard employee’s supervisor say, in a derogatory manner, “I don’t even know what [Filipino employees] are saying half the time” was not hearsay.
