Navarrete v. Kinkisharyo Int’l, LLC, 845 F. App’x 515 (9th Cir. 2021)

An employee who was disabled due to depression, anxiety, and suicidal ideation filed suit against his employer claiming discrimination and failure to accommodate, in violation of California’s Fair Employment and Housing Act (FEHA). The United States District Court for the Central District of California, R. Gary Klausner, J., granted the employer summary judgment. The employee appealed.  The Court of Appeals for the Ninth Circuit held that: 1. the employer’s reasons for terminating employee, in that he had committed timecard fraud, was legitimate and nondiscriminatory; 2 the co-worker was not a proper comparator; 3. the employer did not fail to accommodate employee’s mental health disability; and 4. a witness had personal knowledge of events triggering employee’s termination, rendering his testimony admissible on motion for summary judgment.
